This Privacy Policy describes the policies of Emily’s Hope, Inc., 6225 S. Minnesota Ave., South Dakota 57108-2559, United States of America (the), email: compliance@emilyshope.charity, phone: 6054969876 on the collection, use and disclosure of your information that we collect when you use our websites ( emilyshope.charity, morethanjustanumber.org, and emilyshopeedu.org ). (the “Service”). By accessing or using the Service, you are consenting to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.
We may modify this Privacy Policy at any time without any prior notice to you and will post the revised Privacy Policy on the Service. The revised Policy will be effective 180 days from when the revised Policy is posted in the Service and your continued access or use of the Service after such time will constitute your acceptance of the revised Privacy Policy. Student Privacy Pledge Compliance: As a K-12 School Service Provider, we are committed to protecting student privacy in accordance with the Student Privacy Pledge. While we currently do not collect any Student Personally Identifiable Information (PII), should we do so in the future, we commit to using such data strictly for educational purposes or as authorized by the parent/student.
- Information We Collect:
- We will collect and process the following personal information about you:
- Name
- You may also voluntarily provide information around treatment and addiction history for your loved ones through our More Than Just A Number memorial pages.
- Note: We currently do not collect any Student PII. If in the future, we do collect Student PII, these types of data will be collected only for educational purposes or as authorized by the parent/student.

- We collect/receive information about you in the following manner:
- When a user fills up the registration form or otherwise submits personal information.
- When a user interacts with our websites, for which we use Google Analytics, Jetpack, Hotjar, and Hubspot tracking to gather data.
- From public sources
- When a user makes a donation, either through our site with Givebutter or directly through Stripe on an individual memorial page.
- When a user creates a memorial page for a loved one on More Than Just A Number
- When a user makes a purchase through our Shopify store
- We collect/receive information about you in the following manner:
- How We Use Your Information:
- We will use the information that we collect about you for the following purposes:
- Marketing/Promotional, for which we use Hubspot tracking.
- Creating user account
- Customer feedback collection, facilitated by Hotjar
- Support
- Administration info
- Targeted advertising, where Google Analytics, Jetpack, and Hotjar assist in better understanding our audience.
- While we do not currently collect student information, any future possible collection will not be used for behavioral targeting of advertisements to students.
- Site protection

- Analytics, using data gathered through Google Analytics and Jetpack.
- Student PII
- While we do not currently collect student information, any future possible collection will follow these policies:
- We will not sell student PII.
- We will not build a personal profile of a student other than for supporting authorized educational/school purposes or as authorized by the parent/student.
- Will not be used for behavioral targeting of advertisements to students.

- If we want to use your information for any other purpose, we will ask you for consent and will use your information only on receiving your consent and then, only for the purpose(s) for which grant consent unless we are required to do otherwise by law.

- How We Share Your Information:
- We will not transfer your personal information to any third party without seeking your consent, except in limited circumstances as described below:
- Ad service
- Analytics processed through Google Analytics, Jetpack, and Hotjar.
- E-commerce transactions processed through our Shopify store.
- Donation Management Platform – Givebutter, and donation processing through Stripe.
- We use Hubspot for tracking and understanding user interaction with our sites.
- We require such third party’s to use the personal information we transfer to them only for the purpose for which it was transferred and not to retain it for longer than is required for fulfilling the said purpose.
- We may also disclose your personal information for the following: (1) to comply with applicable law, regulation, court order or other legal process; (2) to enforce your agreements with us, including this Privacy Policy; or (3) to respond to claims that your use of the Service violates any third-party rights. If the Service or our company is merged or acquired with another company, your information will be one of the assets that is transferred to the new owner.

- Retention Of Your Information:
- We will retain your personal information with us for 90 days to 2 years after users terminate their accounts or for as long as we need it to fulfill the purposes for which it was collected as detailed in this Privacy Policy. We may need to retain certain information for longer periods such as record-keeping / reporting in accordance with applicable law or for other legitimate reasons like enforcement of legal rights, fraud prevention, etc. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely.
- If collected in the future, student PII will not be knowingly retained beyond the time period required to support the authorized educational/school purposes, or as authorized by the parent/student.
- Your Rights:
- Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. To exercise these rights, you can write to us at compliance@emilyshope.charity. We will respond to your request in accordance with applicable law.
- You may opt-out of direct marketing communications or the profiling we carry out for marketing purposes by writing to us at compliance@emilyshope.charity.
- Do note that if you do not allow us to collect or process the required personal information or withdraw the consent to process the same for the required purposes, you may not be able to access or use the services for which your information was sought.
- Students or their authorized parents have the right to access and correct their PII. To exercise this right, you can write to us at compliance@emilyshope.charity.

- Security
- The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorized alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.
- While we do not collect any student PII at the time of this writing, any future collection would require us to detail our comprehensive security program designed to protect the security, privacy, and integrity of student PII against risks such as unauthorized access or use, or unintended or inappropriate disclosure.
- Third Party Links & Use Of Your Information
- Our Service may contain links to other websites that are not operated by us. This Privacy Policy does not address the privacy policy and other practices of any third parties, including any third party operating any website or service that may be accessible via a link on the Service. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
- Any vendors with whom Student PII is shared in order to deliver the educational service are obligated to follow these same commitments for the given Student PII.
- Shopify Store
- Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.
- If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

- Givebutter
- Donations made through our websites are processed by Givebutter, our Donor Management Platform. When making a donation, personal information such as name, email address, and payment information is collected by Givebutter to process the transaction. Givebutter also utilizes cookies to enhance your donation experience.
- Givebutter may send emails to donors on our behalf. This is to provide you with information about your donation or to provide updates and news about our work.
- Please note that any information you provide during the donation process is subject to Givebutter’s own Privacy Policy and Terms of Service, which we encourage you to review.
- If you have questions or concerns about Givebutter’s handling of your personal data, you should contact Givebutter directly. Please be aware that we do not have control over the practices of such third-party platforms.
- Zapier
- We use Zapier, a tool that helps us automate tasks between web apps, to manage and move data between different systems. The data processed through Zapier is subject to their own Privacy Policy and we encourage you to review this and the tool’s Privacy Overview.
- Benchmark Email
- We use Benchmark Email for our email marketing initiatives. When you sign up for our newsletter or opt-in to receive other marketing communications from us, your email address and other relevant information is processed by Benchmark Email. - Successor Entities
- In the case of a merger or acquisition, any successor entity will maintain the Student PII and will be subject to these same commitments for the previously collected Student PII.
